What rules apply to foreign buyers in Ajman?

  • Every purchase must be registered. Ownership passes only when the Department registers the sale and issues a title deed in your name.
  • Apartments need a developer NOC. The seller must obtain a clearance certificate from the developer before the transfer.
  • Off-plan payments go into escrow. Projects must be registered with the Department, and buyer payments go into the project’s escrow account.
  • Use a registered agent. Real estate offices must hold a registration certificate from the Department.

Yes. Mortgage limits are set by the Central Bank of the UAE:

What rights do foreign owners have?

A registered freehold owner can sell the property, rent it out, mortgage it, gift it to first- or second-degree relatives with a court letter, and pass it to heirs. Each of these is registered with the Department as its own transaction, with its own documents and fee.

Does buying property in Ajman give foreigners residency?

Not automatically. The UAE Golden Visa for property investors requires owning property worth at least AED 2 million, proven by a letter from the property registration authority. Common mistakes foreign buyers make

  • Assuming a whole neighbourhood is freehold without checking the specific building.
  • Paying off-plan instalments to anyone other than the project’s escrow account.
  • Dealing with an agent whose office is not registered with the Department.

Frequently asked questions

Can a company own property in Ajman?

Some can. Under a 2019 cooperation agreement between Abu Dhabi Global Market (ADGM) and the Department, companies registered in ADGM can own property in Ajman’s freehold areas. Other company structures should confirm their eligibility with the Department before buying.

Do I need to be in the UAE to complete a purchase?

Not necessarily. You can appoint someone under a power of attorney to sign on your behalf. If you are in the UAE but cannot visit, the Department offers off-site signature authentication, starting at AED 300 within Ajman.

What do I need to do before renting out my property?

The Municipality and Planning Department attests residential leases in Ajman through its Tasdeeq service. The attestation fee is 2% of the rental value, with a minimum of AED 400 for expatriates, and the service takes about one working day.

Which inheritance law applies to non-Muslim foreign owners?

Federal Decree-Law No. 41 of 2022 on Civil Personal Status sets out inheritance and will rules for non-Muslim foreigners in the UAE. The Department transfers property to heirs based on a court inheritance letter, for a fee of AED 500. A properly registered will can make this simpler, so take legal advice.

Can I use a personal loan or credit card for my down payment?

No. Central Bank of the UAE rules require the down payment to come from your own resources, not from personal loans or credit cards.

Can I get an interest-only mortgage on an investment property?

Possibly. Central Bank rules allow deferred principal repayment only on investment loans, and for no more than five years from the first drawdown. Owner-occupier home loans must repay principal from the start.

How do banks assess affordability for a buy-to-let purchase?

Banks must deduct at least two months’ rent from the expected rental income to allow for vacant periods. They must also stress-test repayments at 2 to 4 percentage points above the current interest rate.

Does the Department value properties?

Yes. It carries out property valuations for individuals, courts and institutions, including valuations for Golden Residency applications.

Will I receive a paper title deed?

Title deeds, ownership certificates and initial registration certificates are now issued digitally, through UAE PASS or the Department’s document wallet, so you can download them at any time.
